What is it with the word "asylum"? -
Seems that the online distribution platform they chose for the pilot also closed down.

I wonder if posting about Digger's own scam in the comments section of that article would get his attention
Also - looking back at the KS page, it's not only the Minimates that he hasn't delivered. So many promises unfulfilled:
- Digital Download of an Exclusive Screensaver
- Digital Download of Minimates Key Art Turn-Arounds
- Your Name in the Thank You Section of the AGENT 88 Website
- HD DVD of AGENT 88 PILOT
- Key Art Turn-Around Mini-Poster Signed and Numbered by Digger and Agent 88 Actress Kay D'Arcy
- HEAVY METAL FAKK2 MOVIE SPECIAL (not sure if this shipped with the art book)
- WOMAN'S TANK TOP & HEART - INCLUDES White 88 Tank Top with Pink Design, OR Pink 88 Tank Top with White Design... Heart Shaped Dog Tags with A88 Logo
- A88 on the STREET PACKAGE - INCLUDES: Hoodie with Agent 88 Graphic... A88 Eight Ball Keychain...
- etc... etc... etc...

Somebody who knows how to set up a Facebook fan page should create one and highlight what's going on. Call it "Agent 88 Scam" or something like that. Then post screenshots of Digger's/Jan's bogus updates. Maybe even show screenshots of his personal FBposts where he usually gloats about his projects. Then buy ads for it on Facebook and have the ad appear on the actual Agent 88 fan page.
-
I don't think there's anything sketchy about that. If they really wanted to deceive, they would create a fake account and post as a fan that way. Someone probably just sent an e-mail, and they are doing the best damage control they can by reposting those messages on the Kickstarter page.
I don't think they can do that under a newly registered (fake) account because only backers and project owners can post comments.
Again, why would a supposed backer have to email his comments to Jan when he could easily post it himself? It is a response to the earlier post by Ryan Adams after all.
-
Looks to me like Jan didn't realize she was signed in under Digger's account when she posted the "backer" comment.
Jan has been posting there under Digger's account (see her past updates).
Those 3 posts stood out for me as an attempt to create the illusion of a "nameless backer" defending the producers. I think it backfired when she realized after posting that she was actually posting as Digger (duh). And to "fix" that, she adds "This is a message that was sent to me and I am posting here for the backer as requested..."
Ask yourselves, why would a backer need Jan or Digger to post messages on his or her behalf?
If that backer really existed and wanted to come to their defense, he or she would have posted directly. No need to send to Jan (who doesn't have a KS account herself) to do it.
-
Has anyone seen the latest posts by Digger/Jan/whoever on the KS comments page?
https://www.kickstarter.com/projects/1460783231/agent-88-the-web-series/comments
I think it's another BS story.
The second one, they added "This is a message that was sent to me and I am posting here for the backer as requested..."
Why would a "backer" need somebody else to paste a message for them? All backers have the ability to post comments.
Of course, the latest is the canned BS they've given us before.

Digger sent me a few texts yesterday. He said that he had several meetings with various members of DST staff over Toy Fair weekend, and that production is finally able to begin. He said he will send me concrete dates when he has them, but to expect these late summer.
For crying out loud... that line again? I don't mean to be cynical but how many times can he expect the same joke directed at the same crowd to be funny?
-
The problem with a Facebook page like that is that the get who sets the page up has the right to censor whatever he wants to. So, the post getting deleted isn't surprising. But if you really want to boost public knowledge about all this, I'm sure there are other ways of getting the word out where Digger himself won't be able to silence you. Maybe popular toy forums, for instance.
So post it where he cannot delete it. Like here:

Ha... It keeps getting better.
Anyone else get an email from Kickstarter saying their servers got hacked, and customers' email addresses, passwords, etc were compromised?
I know that's not directly related to the A88 thing, but as that was the first thing I've kickstarted, it sure didn't help get the bad taste out of my mouth...
So Digger now has a 3rd party excuse to delay the shipments even further.
"Due a breach in Kickstarter's security, we have lost all your contact info. Please contact us with your mailing info so we can string you along for another 12 months."
-
and from the writer of A88
William O,Neill:
"Matt, I am sorry to hear this. I'll contact the producer and find out what is going on."
directly."
He's married to the producer

Unfortunately guys Kickstarter only acts as a middleman. They don't touch the cash besides what's paid to them as their final fee. Our best recourse at this point would be to round everyone up who paid for the Mates and have someone file a small claims case against him in his home state.
Agreed. I've exchanged emails with KS roughly 7-8 different times. They have made it clear that they are powerless to help get backers back their money.
If anyone decides to take the lead on filing a suit, please consider me on board.
Alternatively, you can help make as much noise about this matter so the public may know.

Pretty sure that the books haven't shipped. I have a friend there in the US who is still waiting for his to arrive.
I'm also wondering what DST has to say about the "going back and forth" part. I have a feeling it's news to them.

Everyone that funded this needs to make a formal request/demand for a refund from Kickstarter Now. they are starting to listen as i have repeatedly been contacting them.
This is the latest answer they (KS) sent me after multiple attempts at having them step in:
I'm sorry that you haven't heard back about this yet, but I've updated my notes about this creator for future reference, should they submit another project. While I'm not able to do much more than this, I appreciate you taking the time to update me and I'm sorry again that this creator hasn't responded, even after we've reached out. I'll make sure our Trust & Safety team reviews your messages as well - thanks again for writing in.
I also contacted Amazon Payments to ask about the possibility of getting a refund. This is what I got:
I'm sorry to hear that you haven't received the incentives for backing the kickstarter project. I understand that you need a refund for this transaction
Kindly understand that once a transaction has completed, we don't have the ability to cancel or refund the pledge. I hope you understand our limitations.
The only possible way to resolve the issue is by contacting the project creator and explain the situation they may be able to refund your pledge.
I do understand that this may not be the most favorable answer that you are expecting from your query. My apologies, as I couldn’t have been of more help with this situation.
Your patience and understanding in this regard is highly appreciated.
I think the only venue where we can make noise is on that KS comments page of his:
https://www.kickstarter.com/projects/1460783231/agent-88-the-web-series/comments
I see a few other backers there who have also gotten impatient.
Or maybe do it on the IMDB message boards for that piece of crap:
-
OK it might be juvenile, but I'm doing this...

I think that statement is defamatory towards DST because it implies that the delays have been DST's fault all along (which we all know isn't the case). If he insists on using this line of reasoning, then I think DST should sue the heck out of him.
"The Minimates are still held up in production. We are working with Diamond to get back on track. We'll let everyone know as soon as we know something. Hang in there...."If somebody does ask, I think the question should not just be about the Minimates because everything else is delayed. The DVD, the art book, the art pieces - none of these have been delivered as far as I can tell.
Digger still attends conventions. I mentioned the upcoming Michigan con, plus I'm sure he'll be at a future c2e2 or sdcc. Surely someone can ask him in person? I agree with Shanester in that it's best that DST stays out of it officially, but it's great that Zach was able to clue us in on what he has so far. I like youbastards idea of a "Sorry you got porked by Digger." minimate and think I'll one day make that as a custom
-
Phew! What rewards went out? Several of my friends are still waiting for the art book as well as the signed DVD - none of those have shipped nor is there any word on when they can be expected. So it isn't just the Minimates that's held up, it's everything. If by "some of the rewards already went out" he's referring to the red ones given out during last year's Comic Con, then he's a bigger nut than I imagined. As far as I can tell, those were product samples - kinda like the "free taste" you get from supermarkets. "We'll post as we know something" is the biggest punchline out of this sick joke.
Btw, would the board moderators or admin here know if Digger has peeped in here recently? I'm guessing the logins are recorded. So if he has peeped and has not said a word, then that proves that he's nothing but a d1ck. From what I can see on his Facebook timeline, he's online a lot. Blabs a lot, too.
"Digger T Mesch
says:Hi Matt,
A number of the rewards have already gone out, however the Minimates
are still held up in production. We are working with Diamond to get back
on track. We'll post as soon as we know something.
Hang in there....
-Jan and Digger"

Here are some interesting articles on how one person sued a Kickstarter project owner...
http://www.inc.com/eric-markowitz/when-kickstarter-investors-want-their-money-back.html
So I wonder, is there an L.A. lawyer among the backers?
-
This.
I think, in that you have a segment of people who contributed only for the rewards, and have no interest in whether the project gets made or not.
-
A friend of mine suggested these ideas...
Post comments on the Kickstarter page:
http://www.kickstarter.com/projects/1460783231/agent-88-the-web-series/comments
This way, KS sees the problem as well.
Also, since CBS featured it, it might also get some attention if the problem was posted as comments there:
http://www.cbsnews.com/videos/director-releases-crowd-funded-film-agent-88/#postComments
Lastly, IMDB has Reviews and Message Boards where the public can post opinions:
http://www.imdb.com/title/tt3119094/ -
Please do update us when you actually receive the book.
The Minimates delay is very likely on his end, not DST's.
Well - i was finally asked to provide a mailing address for my Art of 88 book to go to.
The minimates are still delayed according to Digger.
-
So much for this promise. The only "showering" we got was a pile of cattle manure.

The Washington state government has just filed the very first consumer protection lawsuit against a KS scammer:
